These Terms and Conditions govern your use of alchemy.luxe and any purchase you make from us. By placing an order or using our website, you agree to these terms. Please read them carefully.

Alchemy operates as a trading name of [Company Name], a company registered in Hong Kong (Registration No. [TBC]). References to "Alchemy", "we", "us" or "our" in these terms refer to this entity.

Placing an order

Order acceptance

When you place an order on our website, you are making an offer to purchase. Your order is not confirmed until you receive an order confirmation email from us. We reserve the right to decline any order at our discretion.

Pre-orders and founding member reservations

During our founding member period, we accept reservations ahead of our first production run. By submitting a reservation, you are expressing intent to purchase. No payment is taken at the time of reservation. Payment will be requested once your order is ready to dispatch, at which point you will be contacted by email with instructions to complete your purchase.

You may cancel or modify your reservation at any time before payment is requested. After payment is processed, standard order cancellation terms apply.

Pricing

All prices are displayed in Australian Dollars (AUD) unless otherwise stated. Prices are inclusive of GST for Australian customers. We reserve the right to change prices at any time, but changes will not affect orders that have already been confirmed.

Payment

We accept payment via the methods displayed at checkout. All transactions are processed securely via our payment provider. We do not store your full payment card details.

For subscription orders, by providing payment details you authorise us to charge your payment method on a recurring basis according to your selected subscription frequency. You may cancel your subscription at any time via your account or by contacting us.

Delivery

Delivery timeframes and costs are set out on our Shipping page. We will make every reasonable effort to dispatch orders within the stated timeframes, but delivery times are estimates and not guarantees.

Risk of loss and title for products pass to you upon delivery. If your order has not arrived within the estimated timeframe, please contact us at hello@alchemy.luxe and we will investigate promptly.

For orders outside Australia and New Zealand, customs duties and import taxes may apply. These are the responsibility of the recipient. We are not liable for delays caused by customs clearance.

Returns and refunds

Our returns and refund policy is set out in full on our Shipping & Returns page and forms part of these Terms. In summary:

• Returns are accepted within 30 days of delivery for unused products in original packaging
• Damaged or incorrect items will be replaced or refunded at no cost to you
• Subscriptions may be cancelled at any time before the next dispatch date
• Pre-orders are fully refundable until dispatch

Your rights under the Australian Consumer Law are not affected by these terms. If a product is defective or not as described, you are entitled to a remedy under Australian Consumer Law regardless of our returns policy.

Products and descriptions

We make every effort to ensure product descriptions, images and information on our website are accurate. However, product appearance may vary slightly from images due to photography and screen colour variation.

Our blends are food products. While we take great care with sourcing and production, we cannot guarantee products are free from all allergens. If you have specific dietary requirements or allergies, please contact us before purchasing.

Product availability may change. If an item you have ordered becomes unavailable, we will notify you and offer a refund or alternative.

Intellectual property

All content on alchemy.luxe — including text, images, design, brand identity, product descriptions and photography — is the property of Alchemy or its licensors and is protected by copyright and other intellectual property laws.

You may not reproduce, distribute, or use any content from this website for commercial purposes without our prior written consent.

Website use

You agree to use alchemy.luxe only for lawful purposes. You must not use our website in any way that could damage, disable, or impair the site, or interfere with any other user's use of the site.

We reserve the right to suspend or terminate access to our website for any user who breaches these terms or engages in fraudulent activity.

Limitation of liability

To the extent permitted by law, Alchemy's liability for any claim arising from use of our website or purchase of our products is limited to the amount you paid for the relevant product. We are not liable for indirect or consequential losses.

Nothing in these terms limits liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded under applicable law including the Australian Consumer Law.

Governing law

These terms are governed by the laws of Hong Kong SAR, subject to the mandatory consumer protection provisions of Australian law that apply to Australian customers. Any disputes will be subject to the non-exclusive jurisdiction of Hong Kong courts, without limiting your rights as a consumer under Australian law.

Changes to these terms

We may update these Terms from time to time. Material changes will be communicated to registered customers by email. Your continued use of our website or services after a change constitutes acceptance of the revised terms.
